The Parties agree as follows:

SERVICES DISCLAIMER

• I understand that the coaching services I will be receiving from Tracy Konane are not offered as a substitute for professional mental health care or medical care and are not intended to diagnose, treat or cure any mental health or medical conditions. I also understand that Tracy Konane is not acting as a mental health counselor or a medical professional.

• I understand that coaching is, at present, an unregulated industry and that Tracy Konane is not licensed by the State of California or any other state. I also understand that for all legal purposes, the services provided by my coach will be considered to be provided in the State of California.

• I understand and agree that I am fully responsible for my well-being during my coaching sessions, and subsequently, including my choices and decisions.

• I understand that coaching is not a substitute for counseling, psychotherapy, psychoanalysis, mental health care, or substance abuse treatment, and I will not use it in place of any form of therapy.

CLIENT’S PARTICIPATION

• Please be on time to the session. Time missed for being late will not be made up.

• Be honest and participate fully. Recognize that our sessions are a safe place to look at what you really want and what it will take to make it happen.

• Our time together is a fun but professional container. Showing up to the session under the influence of drugs or alcohol, or behaving in otherwise inappropriate manner (ie: verbal attacks, harassment) will be grounds for early termination of the session and/or remaining coaching package, without refund.

• Understand that the power of the coaching relationship can only be granted by you and commit to making the relationship powerful. If you see that the coaching is not working as you desire, communicate and take action to return the productivity to the relationship.

REFUNDS
Tracy Konane does not offer refunds for any services rendered or payments made. This contract is made between two mutually agreeing parties. If at any time either party decides to end the coaching arrangement, there will be no refunds for payments made for services rendered.

CONFIDENTIALITY
This Agreement is considered a mutual non-disclosure agreement. Tracy Konane promises that all information provided by you will be kept strictly confidential as permissible by law. Both Parties agree not to disclose, reveal, or make use of any information learned by either Party during discussions without prior consent. You are not authorized to use any of Tracy Konane’s intellectual property for your business purposes.

NON-DISPARAGEMENT
You shall not make any false, disparaging, or derogatory statement in public or private regarding Tracy Konane, her employees, or agents. Tracy Konane shall not make any false, disparaging, or derogatory statements in public or private regarding you and your relationship with her.

CLIENT RESPONSIBILITY/NO GUARANTEES
You accept and agree that you are 100% responsible for your progress and results from the program. Tracy Konane will help and guide you; however, participation is the one vital element to your success, and that relies solely on you. Tracy Konane makes no guarantees, verbally or in writing, regarding your results. You understand that because of the nature of the sessions, the results experienced by each client may significantly vary.
